Trail Hub Ltd. – The Bike Shop at Trail Hub
Effective Date: January 1, 2026

These Terms & Conditions (“Terms”) govern your access to and use of www.trailhub.bike (the “Site”) and the purchase of products from Trail Hub Ltd., operating as The Bike Shop at Trail Hub (“Trail Hub,” “we,” “us,” or “our”).

By accessing or using the Site, creating an account, or placing an order, you agree to be legally bound by these Terms, our Privacy Policy, and our Shipping & Returns Policy.

If you do not agree, you must not use the Site.

Nothing in these Terms limits your rights under applicable Canadian consumer protection legislation.

 

 

1. Eligibility and Acceptance

You must be the age of majority in your province or territory of residence to place an order.

By placing an order, you represent that:

  • You are legally capable of entering into binding contracts

  • All information provided is accurate and complete

  • You are authorized to use the payment method submitted

 

 

2. Electronic Communications

By using the Site, you consent to receive electronic communications from us relating to:

  • Orders

  • Account updates

  • Policies

  • Transactional notices

Electronic communications satisfy legal requirements for written communication.

Marketing communications are governed by CASL and require appropriate consent.

 

 

3. Product Descriptions and Availability

We make reasonable efforts to ensure that:

  • Product descriptions are accurate

  • Pricing is current

  • Images represent the product

However:

  • Colours may vary due to display differences

  • Specifications may change without notice from manufacturers

  • Inventory errors may occur

All products are subject to availability.

We reserve the right to:

  • Limit quantities

  • Discontinue products

  • Substitute comparable items where appropriate

  • Cancel orders where inventory is unavailable

If cancellation occurs after payment, a full refund will be issued.

 

 

4. Pricing, Taxes, and Errors

All prices are listed in Canadian Dollars (CAD).

Applicable taxes, including HST, are calculated at checkout based on your shipping address.

In the event of a pricing error:

  • We reserve the right to correct the error

  • We will notify you before proceeding

  • You may cancel for a full refund

We are not obligated to honour pricing errors caused by technical malfunction or obvious clerical mistake.

 

 

5. Order Acceptance and Contract Formation

An order submitted through the Site constitutes an offer to purchase.

A binding contract is formed only when:

  • Payment authorization is confirmed, and

  • We issue a shipment confirmation or pickup notification

We reserve the right to:

  • Refuse or cancel any order

  • Limit quantities per customer

  • Cancel orders suspected of fraud, resale, or abuse

 

 

6. Payment Processing and Fraud Prevention

All payments are processed by secure third-party payment providers.

Trail Hub Ltd.:

  • Does not store full credit card numbers

  • May conduct fraud screening

  • May require identity verification

Orders flagged as high risk may be cancelled at our discretion.

Chargebacks initiated without prior communication may result in account suspension.

 

 

7. Shipping, Delivery, and Risk of Loss

We ship within Canada only.

Delivery timelines are estimates and not guarantees.

Risk of loss and title transfer to the customer once the order is delivered to the shipping carrier.

We are not liable for:

  • Carrier delays

  • Weather disruptions

  • Lost packages after confirmed carrier acceptance

8. In-Store Pickup

For pickup orders:

  • Government-issued ID may be required

  • Orders must be collected within 14 days

  • Unclaimed orders may be cancelled and refunded

 

 

9. Returns, Refunds, and Exchanges

Returns are governed by our Shipping & Returns Policy.

We reserve the right to:

  • Refuse returns that do not meet eligibility standards

  • Inspect returned items before refund

  • Issue partial refunds where damage or wear is identified

Nothing in this section limits your rights under the Ontario Consumer Protection Act.

 

 

10. Cycling Product Safety and Assumption of Risk

Cycling and outdoor activities involve inherent risks of injury.

By purchasing cycling products, you acknowledge:

  • Improper installation or use may result in serious injury or death

  • Professional installation may be required

  • You are responsible for ensuring product compatibility

  • Protective equipment must be properly fitted

Trail Hub Ltd. is not liable for injury resulting from:

  • Improper installation

  • Failure to follow manufacturer instructions

  • Product misuse

  • Unauthorized modification

This does not exclude liability where prohibited by law.

 

 

11. Manufacturer Warranties

Many products carry manufacturer warranties.

Trail Hub Ltd.:

  • Does not extend additional warranties beyond those required by law

  • May assist with warranty facilitation

  • Is not responsible for manufacturer policy decisions

Statutory warranties under the Sale of Goods Act (Ontario) apply where applicable.

 

 

12. Limitation of Liability

To the maximum extent permitted by law:

Trail Hub Ltd. shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Lost profits

  • Loss of data

  • Loss of business opportunity

Total liability for any claim shall not exceed the purchase price of the product in question.

This limitation does not apply where prohibited by law.

 

 

13. Indemnification

You agree to indemnify and hold harmless Trail Hub Ltd., its directors, officers, employees, and agents from claims arising from:

  • Breach of these Terms

  • Product misuse

  • Violation of law

  • Third-party claims resulting from your conduct

 

 

14. Intellectual Property

All content on the Site is the property of Trail Hub Ltd. or its licensors and is protected by Canadian and international copyright and trademark laws.

You may not:

  • Reproduce

  • Distribute

  • Modify

  • Commercially exploit

any Site content without written permission.

 

 

15. Account Security

You are responsible for maintaining account confidentiality.

We are not responsible for unauthorized access resulting from your failure to secure login credentials.

Accounts may be suspended for:

  • Fraud

  • Excessive returns

  • Abuse

  • Policy violations

 

 

16. Third-Party Links

The Site may contain links to third-party websites.

Trail Hub Ltd. is not responsible for:

  • Third-party content

  • External privacy practices

  • External transactions

 

 

17. Force Majeure

We are not liable for failure to perform obligations due to events beyond reasonable control, including:

  • Natural disasters

  • Government restrictions

  • Supply chain disruption

  • Labour disputes

  • Transportation interruption

 

 

18. Governing Law and Jurisdiction

These Terms are governed by:

  • The laws of the Province of Ontario

  • The federal laws of Canada applicable therein

Disputes shall be resolved in Ontario courts, unless otherwise required by consumer protection law.

 

 

19. Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

 

 

20. Changes to Terms

We may update these Terms at any time.

Revised Terms take effect upon posting with an updated Effective Date.

Continued use of the Site constitutes acceptance of changes.
